FDA Orders Family Farm with Perfect Record to Destroy $250,000 of Cheese

The disputed ink is barely dry on s 510 and it would seem the FDA has given itself the ‘authority’ to attack small farms. Although not one person has reported illnesses from Morningland Dairy’s cheese in the cheese makers 30 year long perfect record, the FDA has ordered the farm to destroy $250,00 worth of cheese. Samples taken from Morningland Dairy’s cheeses sold at the Rawesome store in Venice, CA tested positive for the harmful bacteria staphylococcus aureus and listeria monocytogenes. The results of these samples are questionable, the cheese tested had been in CA for 4 months before being collected and wasn’t tested until 7 weeks after being confiscated. Under CA statutes, confiscated food is to be tested right away and a sample sent to the company in question so they can do their own testing, Morningland Dairy never received a sample of the allegedly contaminated cheese.
Almost 70,000 pounds of cheese were recalled and a small farm was ordered to destroy 8 months worth of stored cheese without the FDA doing any more testing or allowing it to be done by the farm itself. The small family run dairy farm has countered the attack with sensibility only to be met with bumbling, bullying demands and lack of proof of the contamination. If Morningland Dairy were to lose the income from all of their dedicated effort, the families that have worked on this farm will be destroyed and one more supplier of essential health foods will be eliminated from the already debilitated food supply. The FDA refused to allow testing to be done on the cheese that was ordered destroyed even after swabs of the entire cheese facility and barns came back clear, throughout this waiting game the cheese goes to waste and the opportunity to salvage the farms income dwindles. Precisely what the Food and Drug Administration wants. This is just one example in many of how dangerous the FDA’s control over food has become in this country.
While a ‘habitual violator’ such as Austin “Jack” DeCoster (Wright County Farms) who stands in the middle of the salmonella contamination mess this summer brought on by facilities riddled with rats and animal (including wildlife) waste continues to do business, small family operated farms are being crushed by profit margins. Jack gets to keep working and profiting as he violates environmental and employee rights time and time again, even paying fines to resolve charges of sexual harassment and rape by company supervisors. How does it make you feel to know that his company has been cleared by the FDA to start selling eggs again as of November 30th? Where were the FDA officials to shut him down? Why wasn’t the FDA keeping a close eye on this repeat offender, taking sample of his products? Why was he still allowed to do business after so many violations?
The priorities of the FDA to focus on companies that produce and sale nutritionally packed whole foods made by small farms that have no history of unsafe foods – instead of ending the painfully disgusting practices of BigAgra – is what puts the food consumers of America at risk. Morningland Dairy is the latest attempt by the FDA to fulfill the Healthy People 2020 objective to kill raw dairy. Morningland is owned by Joseph and Denise Dixon, who operate the cheese plant and make raw cheese from cows kept right on the property and managed by one of their eldest daughters. They have 12 children, 4 who still live at home, and they have been actively engaged in real food for decades. They were caught up in the Rawesome Raid dragnet and many believe the questionable California Dept of Food and Agriculture tests on their cheese are the legal justification for the multi-agency guns drawn raid at Rawesome.
In the thirty years of Morningland Dairy operations NO ONE has become ill from consuming their products. Yet they have been ordered by the Missouri Milk Board to destroy ALL of their cheese without actual tests being performed on the cheese stock. This is nearly 50,000 pounds of cheese, or approximately $250,000.
Since the Milk Board and the FDA showed up at Morningland on August 26th, they have been “embargoed” from shipping or making any product. They dumped their milk for nearly six weeks before being approved to send it into homogenized, pasteurized distribution. All the while, they have had to pay the bill to keep the dairy and cheese plant operable.
On September 24th, the Milk Board verbally ordered Morningland to destroy their product. Morningland asked that this order be put in writing. One week later the order was hand delivered to General Manager/owner, Joseph Dixon. The order states that in three business days the Milk Board would contact them with when and how the cheese was to be destroyed.
Morningland Rebuts the Destroy Order and Offers a Solution
Morningland dared to publish a written objection to committing suicide, a rebuttal and proposed remedy. They rebutted many of the stated “facts” in the 10-page order, Destroy Orders: Morningland Dairy. The Morningland Dairy then offered a reasonable, logical, scientifically sound remedy to destruction on the afternoon of October 6th.
Gov’t Pushes Forward to Destroy Cheese, and Farm
The next morning, they were served with a restraining order and preliminary injunction by the Attorney General’s office of Missouri. They were to be in court the very next day. In sum, they were ordered to destroy their wealth on Friday, asked for logic and justice on Wednesday, notified they were being sued on Thursday and ordered to be in court on Friday.
At 4:50pm on Thursday, the Attorney General’s office called and canceled court because one or two of their witnesses couldn’t attend. Never mind that a family run dairy and cheese plant with 9 families making a living through it should mount a legal defense against destruction in one day. It’s another raid using Gestapo legal tactics that fit the MO of the FDA and their minions….or sub agents, if you prefer.
As readers of this blog and those in the real food movement know, the FDA has a mission. They have blatantly stated that you have no right to consume foods of your choice, and the FDA Plant and Dairy head has a documented Howard Hughes like fear of raw dairy. They are happy to use their resources to “protect” you from consuming things that don’t make any one ill. They’ve reduced science to superstition. If they get more power through S.510, they will regulate the family farm and real food to death and give you Cheez Whiz and Twinkies as government approved food.
WHAT YOU CAN DO TO HELP
To fight for your right to choose what you want to eat, Morningland must be able to go on the offense. They are willing to sacrifice everything they have worked for to stand for your ability to eat real food.
Friends of Morningland have put up a website, The Uncheese Party. They are asking supporters to sponsor a cheese to help the family out financially. For as little as $5 you can tell the FDA and their minions that you are smart enough to decide what you want to eat and don’t need their permission or “help” to figure out what is “good for us”. This battle must be won.

S. 510′s not near Obama’s desk never mind inked. It’s in the Ways and Means Committee because they have to decide whether to let it go with the Constitutional violation, scrap it or re-write it…so this is not the fault of S. 510…this is overreaching somebody on a power trip crap. I think this is horrible personally but it’s not S. 510′s fault. I don’t like S. 510 btw.
What sensible people should do is refuse to buy all other types of dairy for six months or until they begin to listen to “WE THE PEOPLE”. There are alternatives sources for the nutrients got from dairy.
Another alternative is to put this in a referendum at the next election.
Hopefully beginning in Jan. we can get our “Take back America” movement underway! Then I pray we can get even more conservitives in power to rein in these OUT OF CONTROL beurocracy’s!! If the people continue our fight for a real America again we can win this war against COMMUNISM!! OTERWISE we can kiss our liberty goodby!!!!!

I am so tired of the FDA and their tyranical bullying..they are allowed to get away with too much injustice. I swear they are run by the devil himself. They are only out for the big companies who pay them off. There has to be someone to stop this nonsense.
The law was not followed, the dairy swabbed and tested clear. It becomes obvious that the contamination occurred in transit, in California, or at the laboratory. Whomever in the FDA signs off on this should be held personally responsible for their incompetence. I work in the transportation industry and have seen first hand unclean persons handling food and filthy grocery warehouses.
It sounds like someone on the Missouri Milk Bord, and or High level state official wants the land the farms are on.
Just sounds too neat, and they may possibly have an inside source, since they seem to be fully prepared to deflect anything the farms are doing in their defense.

“WE THE PEOPLE” is not about conservatives , it is the conservatives or perhaps I should clarify that and use the party name (republicans) that have ruined this country , and its economy , and all but handed over control of this country to “COMMUNIST” china.
President Obama and the democratic party might lean towards socialism but compared to communism I will take socialism any day.
think of the time table.
(1)it was the republicans who first lowered the taxes of the rich to help the economy way back in the 70′s durring regans reign.
this lowering of taxes didnt seem to help “OUR” economy , but it probably helped to build thousands of manufacturing plants in “COMMUNIST CHINA”
(2) it was bush senior who gave birth to the nafta free trade , although folling his reign it was signed into law by a not so willing President Clinton.
now the stage was set , the only thing left was to remove all barriers to trade with china , that accomplished and following that the quick demise of the American economy was well underway.
