City Ordinance Demands Keys From Citizens for Lock Boxes

For citizens of Cedar Falls, Iowa, ordinance 2740 (unfunded city-wide mandate) means a forceful requirement to hand the government their keys for their safety. Keys will be kept “safe” on mostly commercial properties through universal lock boxes that emergency responders can access.

The program’s intent is to provide increased safety and protection to personal, private property which include businesses, apartments and some rental houses which comes at a dollar expense and fundamental constitutional rights.

Many city people vehemently fought the ordinance on constitutional grounds, potential for abuse, and common sense. “If my place is on fire, why would I care if the fire department destroys the door instead of using the key?”

The final vote was tonight – do you think the City Council respected the wishes of its people or noticed the petition and phone calls from across the country?

Opposition organizes to beat key box ordinance

CEDAR FALLS, Iowa — Opponents of an expanded key box ordinance in Cedar Falls don’t plan to go down without a fight.

A group of people who say the ordinance is a risk for invasion of citizens’ privacy and an unnecessary cost for businesses are mounting a campaign to keep it out of the books.

Judd Saul developed a video based on footage from the May 23 City Council meeting and posted it to YouTube. He and others opposed to the ordinance are spreading the word to people they know and expect a big crowd at the June 13 council meeting to speak against the requirement of key boxes.

“If it does pass, we are going to file a lawsuit,” Saul said. He believes it is unconstitutional.

The ordinance in question is adoption of the 2009 International Fire Code. As part of the code, the fire official can require installation of key boxes. In Cedar Falls, Fire Chief John Schilling determined the city should require the boxes for commercial buildings and apartment buildings with three or more units.

Cedar Falls had required them for commercial buildings and apartment buildings with six or more units since 2004.

The key boxes are installed on the exterior of a business. The property owner deposits keys needed for emergency access to the building inside. A master key kept at the fire department allows supervisors to access the keys.

Most boxes can be installed for between $250 and $500. Some models can send an alarm to the property owner when the box is opened.

The ordinance already has passed two of three readings required for approval. If the third reading is passed June 13, it becomes law. The council voted 6-1 in favor of the ordinance May 23, with Nick Taiber casting the only vote against it.

Saul said those opposing the ordinance plan to air an ad on Cedar Falls cable television this week and will be circulating a petition.

“We’re pounding the pavement full force getting that petition started,” Saul said.

Cedar Falls City Council OKs controversial lock box ordinance

CEDAR FALLS, Iowa — The City Council passed a controversial ordinance that expands the use of lock boxes in Cedar Falls.

As in the first two readings of the ordinance, the ordinance passed by a 6-1 vote, with Nick Taiber casting the lone dissenting vote.

A dozen citizens spoke out against the ordinance, while just one spoke in favor of it.

The issue had caught fire on the Internet in recent days and council members had been subjected to hundreds of calls and e-mails from people around the nation who objected to it.

About 55 people attended the meeting, nearly filling the council chambers.

One person yelled at the council as he left the meeting “Thanks for ignoring the citizens.”

    This is New World Order one world government being implemented by incremetalism. You will notice this is based on international law, not US or state law. Progressive lawmakers, like this city council, do not care about the people or their wishes. These liberal progressives do not have a life or value system of their own so they do not want you to have one either. If not stopped they will destroy America.

    There’s nothing in the past behavior of any government entities that would lead us to believe they would EVER feel any of our property was rightfully theirs! I would feel totally safe having ALL my property via keys in THEIR hands. NOT!!!!!

    In 1984 we breathed a sigh of relief. Nothing happened. Well it just took longer; everyday I hear of another erosion of our freedom. This one takes the cake. Real Estate sales use lock boxes here and they experiences abuses all the time. Burglers will be laughing all the way to their ‘fences’. our children will grow up thinking that lock boxes are normal. Why bother locking anything?

    The primary thing to recognize here is the same thing that is happening at all levels of government within the US: party is irrelevant; voters and votes are irrelevant; people are irrelevant; the personal agenda of the elected official is all that matters. And that devotion may be directed toward the wealthy as with the brothers grim, or corporations who will give them lots and lots of money in trade for new laws that let them continue to use the population as a money farm.

    I loved what the one gentleman stated, something we have all forgotten and are kept too busy, too suppressed, and even ignored to be able to have impact on it:

    THE CONSTITUTION WAS NOT ADOPTED SO THAT GOVERNMENT CAN CONTROL PEOPLE, IT WAS ADOPTED SO THAT THE PEOPLE CAN CONTROL THE GOVERNMENT.

    It really is this simple. The government has too much power. The exact thing that the Constitution was designed to prevent, has happened.

    Today, while millions of American Citizens are homeless, jobless, and have no hope, Obama is where? IN PUERTO RICO trying to secure the Hispanic vote. That costs the citizens millions of dollars.

    Their winning is all that matters to them along with how to write laws to legally get more of our money into their pockets.

    At a time when cities, states, and the federal budgets are so corrupt due to the crappy people who waste our money, I can’t beleive that this city has chosen to spend it’s time enacting something so ugly, so unconstitutional, and so unpopular.

    As the elected ignoramus stated, “We will do as we see fit.” And so they did.

    If you think you “own” your property (house, commercial building, etc.), you are sadly mistaken. Look up the following:

    Senate Document # 43; SENATE RESOLUTION NO. 62 (Pg 9, Para 2) April 17, 1933. “The ultimate ownership of all property is in the State; individual so-called “ownership”is only by virtue of Government, i.e., law, amounting to mere user; and use must be in accordance with law and subordinate to the necessities of the State.” (Emphasis added)

    You are only granted “use” (possession) of any property that is on the rolls of any town/city/state. That’s why when you don’t pay your property taxes (rent), they can take your property away from you.

    First, fix the ownership situation in all of the US, then all of this other nonsense will disappear.

    Wow, it seems that it’s a rather common opinion of people in government that they know better that we do. We just saw that a couple months ago in our town. Many local elections have an extremely low turnout so it’s not uncommon for the elected officials to only be those who are willing (or wanting) to run. In our town, ~30% of the town voted in the last city council election which means that ~16% of the town can dictate who’s in charge, does that sound right? The only way to get through to some of these people is at the ballot box so get your neighbors out to vote in the next election.

    This is horrible, the direction this country is going is scary. Big corporations control big government and it is out of control. And for those of you who say this is a liberal or progressive agenda, think again. It’s way beyond either one. I happen to be liberal and I do not agree with this type of government intrusion in any way.

    Democrat politicians have a different agenda than Democrat voters. The politicians have been slowly moving their platform to socialism. It is this bit-by-bit lawmaking that is allowing socialism to eventually become the norm. Democrat politicians only need Democrat voters to vote them in to continue this agenda. The old Democrat platform only lives in the minds of Democrat voters. Those of you who are Democrats PLEASE research your candidates before voting. You may find they have a hidden agenda to carry out a socialistic conversion of this country!

    Big Brother continues to encroach. This is blatantly unconstitutional – but then, you can ask any TSA agent, and they will tell you that they violate your rights because they are OUTSIDE the constitution. Apparently this sitting city council believes they, too, are outside of the UNITED STATES CONSTITUTION which they, and all elected officials in this nation swear to uphold and defend.

    We’ve lost our integrity, our freedom and our security from our own tyrannical government, one little encroachment at a time.

    Fight back folks. The people ARE the government in this nation – and we must take it back.

    I live in an 8 story condominium in a Washington DC neighborhood. Our building has had a lock box for the fire department for over 20 years. There has never been an incidence of theft, rape or murder arising from the existence of the fire department’s lock box on our building. I was surprised to see this as an issue of outrage for local citizens. Cedar Falls must be becoming a larger city that has large buildings that do not have 24/7 front door receptionists or building engineers on staff. The buildings are locked for the general safety of the occupants….not just anyone can walk in. But to give easier access to local fire departments to secured public or commercial buildings without their needing to bash through plate glass doors or heavy metal doors which many commercial properties often have should not be considered a constitutional issue for residents in my point of view. Believe me, doors and the security systems that usually are attached to them are not cheap and they are costly and time consuming to repair. One should be also consider the safety issue for the firefighters who are wearing 80 pounds of equipment to start off with when they arrive at an emergency scene. Many in our building, including myself, have changed the locks in our deadbolt so as to prevent many from entering our residences without prior arrangement or permission. If the building engineer needs access, I leave the deadbolt unlocked for the prearranged day while I am at work. Or I hang around waiting for repair people. No one has access to my property without permission. Nevertheless, I believe fire departments should be given access to large buildings without having to use force to get through the primary door.
